Are you sure that alternative Smith fails these? How could alternative
Smith fail if DMC passes? If people only approve their first choice in
DMC, the result should be identical to the result given by alternative
Smith. Thus, a failure example for alternative Smith should also be
applicable to DMC.

Don't you think that alternative Smith is cloneproof? My guess is that it
is.
